Terms of Service

The short version

Stay Dry is a self-help sobriety companion made by SoberDad Coaching LLC. It is not medical care, therapy, or addiction treatment, and the coach is an AI, not a person. Subscriptions renew automatically until you cancel, and canceling is always available where you subscribed. If you are in crisis, use the resources in Section 2, not the app. This summary is for convenience; the full Terms below are what applies.

1. What Stay Dry is (and is not)

These Terms of Service (the "Terms") are a binding agreement between you and SoberDad Coaching LLC, a Minnesota limited liability company ("Stay Dry," the "Company," "we," "us") covering the Stay Dry mobile application ("Stay Dry: Quit Drinking"), the website at staydry.app, and all related features (together, the "Service"). By creating an account, subscribing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Stay Dry is a self-help and habit-support tool: a sobriety day counter, milestone medallions, a 30-day educational program, journaling, craving and calming tools, savings tracking, and an AI-powered support coach.

Stay Dry is not a healthcare provider and does not provide medical care, mental health care, therapy, psychotherapy, counseling, diagnosis, addiction treatment, or medical advice of any kind.

Nothing in the Service creates a clinician-patient or therapist-client relationship. The Service is not a substitute for care from a physician, therapist, counselor, or addiction treatment program, and it is not intended to diagnose, treat, cure, or prevent any disease or condition. Always seek the advice of qualified professionals with any questions about your health, substance use, medications, or treatment, and never disregard or delay professional advice because of something in the Service.

Warning about withdrawal: suddenly stopping or sharply reducing heavy alcohol use (and certain drugs, including benzodiazepines and opioids) can be medically dangerous and in some cases life-threatening, including seizures and delirium tremens. Talk to a doctor before changing your alcohol or drug use. Stay Dry does not manage or monitor withdrawal.

2. Emergencies and our safety protocol

The Service is not an emergency, crisis, or suicide-prevention service and is not monitored by humans in real time. If you may be in danger or are thinking about harming yourself or someone else:

  • Call or text 988(Suicide & Crisis Lifeline, US and Canada, 24/7), or chat at 988lifeline.org
  • Text HOME to 741741 (Crisis Text Line, US). In Canada, text CONNECT to 686868
  • Call 1-800-662-4357 (SAMHSA National Helpline, substance use, US, 24/7)
  • Call 911 (or your local emergency number) or go to the nearest emergency room for any emergency, including possible withdrawal symptoms

Outside the United States and Canada: call your local emergency number. Free, confidential crisis lines operate in most countries, and the Service's crisis tools show the verified line for your country where we have one.

Our crisis-response protocol

We publish this so you know exactly how the Service behaves. The AI coach and panic tools run layered safety measures: deterministic screening of user messages for language indicating suicidal ideation, self-harm, or harm to others, plus model-level safety guardrails. When such language is detected, the coach interrupts ordinary conversation and instead presents crisis resources (such as 988, Crisis Text Line, and SAMHSA in the United States, the verified equivalents in other countries we cover, and local emergency services) and encourages immediate human help. The Service is designed not to produce content encouraging self-harm and not to provide instructions for self-injury. These measures are automated, are reviewed and improved over time, and can fail or misclassify; they are not a safety net and do not replace emergency services or professional care.

3. The AI coach

The Stay Dry coach is a computer program powered by artificial intelligence. It is not a human being and cannot feel human emotion. It is not a licensed professional of any kind, and its responses are not therapy, psychotherapy, counseling, or medical advice. It is designed for motivational, educational, self-help support only.

  • AI output can be wrong, incomplete, or inappropriate despite our safeguards. Use judgment and verify anything important with a qualified professional.
  • Never rely on the coach for decisions about medication, withdrawal, detox, diagnosis, or any medical or mental health treatment.
  • Coach conversations are processed by our AI service providers to generate responses, as described in the Privacy Policy.
  • We identify the coach as AI in the product and during signup, and we may remind you periodically during long interactions.

4. Eligibility and your account

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for users in the United States; if you use it elsewhere you are responsible for compliance with your local laws.

You agree to provide accurate information, keep your credentials secure, and accept responsibility for all activity under your account. Tell us immediately at support@staydry.app if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Subscriptions, free trial, and billing

Plans and prices

Stay Dry Premium is currently offered at $13.99 per month or $99.99 per year, and from time to time at promotional rates (for example, a founding annual rate of $49.99 per year available during the launch window). The exact price, term, and any trial are always shown at the point of purchase before you confirm.

Free trial and automatic renewal

Unless you cancel before the end of a free trial, your trial converts to a paid subscription and the payment method you provided is charged the price shown at signup. All subscriptions renew automatically at the end of each billing period, at the then-current rate for your plan, until you cancel.

New subscribers currently receive a 14-day free trial. One free trial per person; we may decline a trial where one was already used. Promotional rates apply for as long as your subscription stays active; if it lapses, the then-current standard rate applies to any new subscription.

How to cancel

  • Subscribed on the web (Stripe): open your Account page at staydry.app/account and use Manage billing, or email support@staydry.app. Online cancellation is available at any time and takes only a few clicks.
  • Subscribed on iPhone (Apple): open iOS Settings, tap your name, tap Subscriptions, and cancel there. Apple subscriptions can only be managed through Apple.

Canceling stops future renewals. You keep Premium until the end of the period already paid (or the trial end, if you cancel during a trial, in which case you are not charged).

Refunds

Except where required by law, payments are non-refundable and we do not give credits or refunds for partial periods. Purchases made through Apple are subject to Apple's refund policies and must be requested from Apple. If you believe you were billed in error, contact support@staydry.app.

Price changes

We may change prices prospectively. If a change affects your renewal, we will give you advance notice and a chance to cancel before it takes effect.

6. Free features

The core tracker, medallions, and panic tools are free. We may change, add, or remove features (free or paid) as the product evolves; if a change materially reduces a paid feature you already paid for, you may contact us about a pro-rated remedy.

7. Your content

Journal entries, check-ins, answers, and messages you create are yours. You grant us a limited, non-exclusive, worldwide license to host, process, transmit, back up, and display that content solely to operate, secure, and improve the Service for you. We do not use your private content to train AI models, and we do not sell it. If you send us feedback or suggestions, we may use them without restriction or compensation.

8. Acceptable use

You agree not to:

  • use the Service for anything unlawful, harmful, or fraudulent;
  • probe, breach, or test the security of the Service, or access data or accounts that are not yours;
  • scrape, harvest, bulk-download, or use automated means to access the Service, or use the Service or its outputs to build or train a competing product or any AI model;
  • reverse engineer, decompile, or modify the Service except where the law gives you that right;
  • resell, rent, or share access to paid features or your account;
  • interfere with the Service's operation, including overloading or disrupting our infrastructure or circumventing usage limits or paywalls;
  • misrepresent the Service as medical care or use it to provide services to third parties.

9. Our intellectual property

The Service, including its software, design, text, medallion artwork, audio, graphics, and trademarks (including "Stay Dry"), is owned by the Company or its licensors and is protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app and site for your own personal, non-commercial use in accordance with these Terms. No other rights are granted.

10. Third-party services

The Service relies on third parties, such as Apple (App Store and in-app purchases), Stripe (web payments), Google and Apple (optional sign-in), and our hosting and AI providers. Their services are governed by their own terms and privacy policies, and we are not responsible for them. Links to third-party resources (including crisis resources) are provided for convenience; we do not control them.

11. Apple App Store terms

If you downloaded the app from the Apple App Store, the following also applies:

  • These Terms are between you and SoberDad Coaching LLC only, not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content.
  • Your license is limited to a non-transferable license to use the app on Apple-branded devices you own or control, as permitted by the App Store Terms of Service (including Family Sharing rules).
  • We, not Apple, are solely responsible for maintenance and support. Apple has no obligation to furnish any maintenance or support for the app.
  • If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund your purchase price for the app (if any); to the maximum extent permitted by law Apple has no other warranty obligation, and any other warranty claims are our responsibility.
  • We, not Apple, are responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, and consumer protection claims, and for the investigation, defense, and discharge of any third-party claim that the app infringes intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Health disclaimer and assumption of risk

Recovery outcomes vary and depend on many factors outside our control. We make no promises that you will achieve or maintain sobriety, save money, or obtain any particular result. Content in the Service (lessons, coach responses, statistics, savings estimates) is general information, provided for motivation and education. You are solely responsible for decisions about your health and substance use, and you agree that you use the Service at your own risk. To the extent permitted by law, you assume all risks associated with relying on the Service in connection with your recovery.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) THE COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR PERSONAL INJURY ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY; AND (B) THE COMPANY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. THESE LIMITS APPLY REGARDLESS OF LEGAL THEORY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE LIABILITY IS LIMITED TO THE FULLEST EXTENT THE LAW ALLOWS.

15. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its owners, officers, employees, and agents from and against claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any law or third-party right.

16. Disputes, arbitration, and class action waiver

Please read this section carefully. It requires most disputes to be resolved through binding individual arbitration and waives class actions and jury trials. You can opt out within 30 days (see below).

Before filing any claim, you agree to email a written Notice of Dispute to support@staydry.app (subject line "Dispute Notice") describing the issue and the relief you want, and to give us 60 days to try to resolve it informally with you.

Binding arbitration

Except for (a) small-claims-court cases that qualify, and (b) suits seeking injunctive relief for intellectual property infringement or unauthorized access, any dispute arising out of or relating to these Terms or the Service will be resolved by final, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. Hearings may be conducted by video or phone, or in your home county if in person. AAA rules govern arbitration fees; we will pay filing and arbitrator fees where the rules or law require. The arbitrator decides all issues except that a court decides issues of arbitrability and the enforceability of the class waiver.

Class action and jury waiver

ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, AND THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS. YOU AND THE COMPANY EACH WAIVE THE RIGHT TO A JURY TRIAL. If the class waiver is found unenforceable as to a particular claim, that claim (and only that claim) proceeds in court.

Coordinated filings

If 25 or more similar arbitration demands are filed against us by the same or coordinated counsel, the parties agree to batch procedures: demands will be resolved in staged sets of up to 50, with a single arbitrator per set, and applicable statutes of limitations are tolled while a demand awaits its stage.

30-day opt-out

You may opt out of arbitration and the class waiver by emailing support@staydry.app with subject "Arbitration Opt-Out" within 30 days of first accepting these Terms, including your account email. Opting out does not affect any other part of these Terms.

17. Governing law

These Terms and any dispute are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 16. For any claim not subject to arbitration, you and the Company consent to the exclusive jurisdiction of the state and federal courts located in Hennepin County, Minnesota, except that either party may bring a qualifying claim in small claims court.

18. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service (with reasonable notice and, where required, a pro-rated refund of prepaid, unused subscription fees). Sections that by their nature should survive (including 7, 9, and 12 through 21) survive termination.

19. Changes to these Terms

We may update these Terms as the Service and the law evolve. If a change is material, we will give you reasonable advance notice in the app or by email. Changes apply prospectively from their effective date, and continuing to use the Service after that date means you accept them. Material changes to Section 16 come with a fresh 30-day opt-out window.

20. Miscellaneous

These Terms, the Privacy Policy, and any purchase terms shown at checkout are the entire agreement between you and the Company about the Service. If a provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. Notices to you may be given in the app or to your account email.
